Privacy Policy
1. Introduction
Applied Atomics, Inc. ("the Company," "we," "us," or "our") operates the website appliedatomicsinc.com (the "Service"). Applied Atomics designs compact modular fission plants for direct co-location with data center campuses, using AI-managed control systems to deliver firm baseload power without grid dependency. In the course of operating this informational website and engaging with prospective power-purchase partners, we collect certain personal information. This Privacy Policy explains what information we collect, how we use it, and the rights you have. It applies to all information we collect through the Service and through direct communications with you.
We are based at 1330 Broadway, Suite 900, Oakland, CA 94607 and can be reached at [email protected].
Our primary website audience is data center infrastructure buyers, industrial power buyers, potential engineering team members, and regulatory and policy professionals. We are not a consumer application; we do not process consumer financial, health, or behavioral data as part of our product.
2. Information We Collect
2.1 Information You Provide
We collect information you submit directly, including:
- Contact details (name, email address, phone number) when you submit a contact form, request partnership information, or express interest in our design partner program;
- Professional context you choose to share, including your company, role, and the nature of your power or infrastructure project;
- The content of messages you send us, including descriptions of planned data center capacity, power requirements, and project timelines;
- Login credentials if you access our partner portal (email address and hashed password).
Because Applied Atomics is in a pre-commercial development stage, the information we collect through contact forms is primarily used to facilitate early design partner conversations and preliminary technical discussions, not to complete commercial transactions. We do not process payment card data through this website.
2.2 Information Collected Automatically
When you visit appliedatomicsinc.com, we automatically collect limited technical information:
- IP address and approximate location (city or region level, not precise geolocation);
- Browser type, operating system, and device class;
- Pages visited, referring URLs, and time on page;
- Cookie identifiers and similar local storage values (see Section 5 and our Cookie Policy).
We do not collect precise device location (GPS coordinates or equivalent). We do not use fingerprinting technologies to track visitors across unaffiliated websites.
2.3 We Do Not Knowingly Collect Children's Data
appliedatomicsinc.com is a B2B infrastructure website directed to energy industry professionals. We do not knowingly collect personal information from children under 13. If you believe a child has provided information to us, please contact [email protected] and we will delete it promptly.
3. How We Use Information
We use the information we collect to:
- Respond to power-purchase and partnership inquiries and provide information about our compact fission plant program;
- Manage our design partner engagement process, including scheduling technical calls and sharing engineering documentation under NDA;
- Operate and improve the Service, including measuring which content is useful to infrastructure buyers;
- Send service updates and (where consent is required) email communications about the Applied Atomics development program;
- Maintain the partner portal and associated account security;
- Detect and prevent unauthorized access to our systems;
- Comply with applicable law, including California privacy law and federal regulations applicable to our nuclear energy development activities.
We do not sell personal information for monetary value. We do not use contact information submitted through this website to train machine learning models. Where California law treats certain targeted advertising arrangements as a "sale" or "share," see Section 9 below.
4. Sharing of Information
We share personal information only with:
- Service providers acting on our behalf, including website hosting, email delivery, and anonymized site analytics, under contractual confidentiality obligations that restrict their use of the data;
- Legal authorities or regulatory bodies when required by applicable law, court order, or to protect the rights, safety, or property of the Company or others;
- A successor entity in the event of a merger, acquisition, or asset sale, subject to this Policy and applicable law.
We do not sell personal information to third parties. We do not share contact or inquiry data with commercial partners or investors without your knowledge and consent.
5. Cookies and Tracking
We use cookies and similar technologies to operate the site, support the partner portal session, and measure aggregate usage. We do not use third-party advertising cookies. For a full description of the cookies we use and your opt-out options, see our Cookie Policy.
6. Data Retention
We retain personal information only as long as necessary for the purposes described in this Policy, to comply with legal or accounting obligations, and to resolve disputes. Specifically:
- Contact and inquiry data from the website form is retained for up to 36 months; we may retain it longer if an active design partner relationship or commercial discussion is ongoing;
- Partner portal account data is retained for the duration of the account and for 12 months after account closure;
- Inactive marketing-list contacts who have not engaged with our communications are removed after 24 months;
- Server access logs are retained for 90 days, then aggregated and de-identified.
7. Security
We use administrative, technical, and physical safeguards designed to protect personal information. These include TLS encryption for data in transit, restricted-access databases, and least-privilege access controls for internal systems. No security system is perfectly impenetrable; we cannot guarantee absolute security, but we take reasonable measures appropriate to the sensitivity of the information we hold.
8. Your General Rights
Depending on your jurisdiction, you may have rights including access to, correction of, and deletion of your personal information, as well as the ability to object to or limit certain processing. To make a request, email [email protected]. We will respond within the timeframe required by applicable law.
9. California Residents (CCPA / CPRA)
Because Applied Atomics is headquartered in Oakland, California and serves California-resident visitors and potential business partners, this section supplements the rest of the Policy to address your rights under the California Consumer Privacy Act ("CCPA") and the California Privacy Rights Act ("CPRA").
9.1 Categories We Collect
In the past 12 months, the Company has collected the following categories of personal information as defined under Cal. Civ. Code §1798.140: identifiers (name, email address, IP address); professional or employment information (company name, role, project details you share with us); commercial information (nature of your power or infrastructure inquiry); internet or network activity (browsing behavior on appliedatomicsinc.com); and inferences drawn from the above for the purpose of managing design partner outreach and improving the Service. We do not collect sensitive personal information as defined under CPRA (such as government identification numbers, precise geolocation, financial account credentials, biometric identifiers, or health data).
9.2 Sources, Purposes, Disclosure
We obtain personal information directly from you (through forms and communications) and through automatic site instrumentation (cookies and server logs). We use it to operate and improve the Service, facilitate preliminary power-purchase discussions, and meet legal obligations. We disclose it only to service providers under written contracts that restrict onward use, and to legal authorities where required by law.
9.3 Your CCPA / CPRA Rights
- Right to Know: request the categories and specific pieces of personal information we have collected about you in the past 12 months.
- Right to Delete: request deletion of personal information we have collected from you, subject to legal exceptions (for example, we may retain information necessary to complete a transaction you requested or to comply with a legal obligation).
- Right to Correct: request correction of inaccurate personal information we hold about you.
- Right to Opt Out of Sale or Sharing: we do not sell personal information; we do not "share" it for cross-context behavioral advertising as defined under CPRA.
- Right to Limit Use of Sensitive PI: we do not collect or use sensitive personal information (as defined under Cal. Civ. Code §1798.140(ae)) for purposes beyond those permitted without authorization.
- Right to Non-Discrimination: we will not deny you services, charge you different prices, or provide a different level of service because you exercised any of the rights described here.
9.4 How to Exercise
Submit a verifiable consumer request by emailing [email protected] with the subject line "California Privacy Request." Please include enough identifying information for us to verify you are the person whose information is the subject of the request. We will respond within 45 days; we may extend the response period by an additional 45 days when reasonably necessary, and will notify you of any such extension.
9.5 Authorized Agents
You may designate an authorized agent to make a request on your behalf. The agent must provide written proof of authorization. We may also require you to verify your identity directly with us.
9.6 "Shine the Light"
Under California Civil Code §1798.83, California residents may request information about our disclosure of personal information to third parties for their direct marketing purposes. We do not disclose personal information to third parties for direct marketing purposes.
9.7 Do Not Track and Global Privacy Control
Under the California Online Privacy Protection Act (Cal. Bus. & Prof. Code §22575), we disclose how we respond to "Do Not Track" (DNT) browser signals. Because there is no common industry standard for interpreting DNT signals, we do not currently alter our data practices in response to them. We do not authorize third parties to collect personally identifiable information about your activity across different websites when you use the Service. We honor an opt-out preference signal sent by a platform or browser that complies with the CPRA, such as the Global Privacy Control (GPC); when we detect a GPC signal, we treat it as a valid request to opt out of the sale or sharing of personal information for that browser or device.
10. Changes to This Policy
We may update this Policy from time to time. Material changes will be reflected by a new "Last updated" date at the top of this page. We encourage you to review this Policy periodically.
